The director of a documentary film about the Gezi resistance, Serkan Koç, has been summoned to appear as a suspect before the Istanbul Public Prosecution charged with “Defaming the prime-minister and inciting malice and enmity among the people”.

53-year-old Emine Cansever, who acquired fame as the ‘catapult auntie’ caught in action in the iconic photograph taken at the height of the Gezi disturbances, has been released from prison after having spent three months in detention. She commented, “Gezi was not only an event about the cutting down of trees. We also struggled against injustice and poverty there. If these events happened again I would go again.”

The Court of Cassation has overturned a ruling by a first instance court finding a 13-year-old child guilty of defaming the prime-minister four years ago in Aydın for saying to him, “I don’t like you. God damn you,” although not imposing a punishment given that the child was too young to be aware of the consequences of his action, on the grounds that this was a curse not defamation, and the law does not punish curses.

Ceyda Sungur, who became known as the “woman in red” after she was photographed being sprayed with tear gas during the Gezi protests (below), has brought proceedings against the police officer involved in the incident, 23-year-old Fatih Zengin. In its indictment, the public prosecution has called for a two-year prison sentence and for the officer to be barred from the profession on the grounds of “abuse of position”. According to the indictment, the officer sprayed tear gas at Sungur and those next to her without giving any warning. The prosecution also alleged that the officer approached to within less than one metre of Sungur and aimed at her face. He continued to spray gas after she had turned round, and even kicked her. It is said in in the indictment that Sungur was not rioting at the time.

The public prosecution has now dropped the charges against the “woman in red”, who previously stood accused of ‘inciting the public to break the law’.

Turkish riot police officer who gassed ‘lady in red’ faces prosecution and possible jail term

A Turkish police officer who sprayed tear gas in the face of a woman wearing a red dress at an anti-government protest faces prosecution and a possible jail term, a legal source has said.

Images of the incident with “the lady in the red dress” became symbolic of the ongoing unrest throughout last summer, quickly spreading on social media and printed on stickers and posters at protest camps.

They appeared to show police officer Fatih Zengin crouching down and blasting tear gas from less than a metre away at Ceyda Sungur.

A forensic report has established a causal relationship between the beating received by Ali İsmail Korkmaz (the student who died in the city of Eskişehir during the Gezi protests) and his death.

Eskişehir Serious Crime Court No 2, which is hearing Korkmaz’s murder case, sent a letter to the Forensic Medicine Institute requesting a report under articles 86 and 87 of the Turkish Penal Code which provide for the offence of ‘wounding’. The court also requested an investigation as to which wound or blow caused his death, whether his other injuries contributed towards his death, and whether the complaint that Korkmaz was said to have had previously or the medication he was taking had any effect in combination with the beating in causing his death.

It was stated in the ensuing forensic report that “There is a causal relationship between the beating that occurred on 2 June and his death on 10 July.” The report also concluded that the medication which Korkmaz was taking facilitated the occurrence of cerebral hemorrhage and increased the bleeding, and thus contributed towards his death.

Thirteen-year-old B.T.İ. is appearing before Çanakkale Penal Court of First Instance No 1 charged with damaging property by writing the slogan “Fascism be damned” on a road in the city of Çanakkale during the Gezi Park protests. The prosecution is calling for a six-year prison sentence.

At the above hearing, at which a social work expert testified that, “At his age, he is incapable of comprehending the consequences of his action,” the court ruled that the thirteen year old lacked penal capacity and that there was no call for a penalty to be imposed.

Sadly, Berkin Elvan passed away at 7 am this morning after having been in a coma for 269 days.
