If you die intestate

Postby sylvia » Fri Apr 04, 2014 10:06 am

Does anybody know if a persons estate value (UK) is only approx 25,000 sterling if one has to by law apply for letters of administration

also if the only child of the deceased has had no contact for 25 years and changed her name to her stepfathers (when she was a child) still could inherit

I think that the UK Law says that if you die intestate your estate is awarded by blood line. So, if she is the only biological child, whether she had her name changed to that of an adoptive father, then she would inherit the lot. If there are other siblings then the estate will be proportioned between all siblings. The criteria is that of having grandparents in common.

Recently went through a similar event and that is what we were told.

That's if there isn't another spouse around. From a friend's experience, bloodline is secondary to last spouse-line in UK (unless challenged?) and adoption is equivalent to bloodline.

Actually, that's wrong. If the person dies INTESTATE the blood line follows (the wife does not automatically get it), children then parents and then other blood relatives.

That's why in any UK will it nearly always begins with the husband or wife leaving all to each other before any other shares.

I just did a quick check, and I'm afraid I am correct. If you die intestate and there is a spouse, the spouse gets the lot. Not the kids (although they could contest). It's sickening, I know.

Anyway, this bit might be irrelevant to Sylvia as her mother may never have married again (making a number of assumptions here, sorry, Sylvia).

In that case i stand corrected as it must have changed.
