The legislation came about after a joint US/Australian bilateral agreement to bring Australia into line with US Export Controls.

The reason is because Australia has some serious shit it could sell, all top shelf. Things like Submarines that can launch Tomohawk Cruise Missiles, Air Warfare Destroyers based on the Arleigh Burk Aegis Fire Control System, AWACS, AEW, Jindalee etc etc.

Australia transported and supplied are large shipment of arms to the Peshmerga after legal advice confirmed that if they had delivered Australian Weapons they would have contravened the Defense Export Act 2012. It would be a serious scandal rivaling Iran/Contra. The shit would hit the fan with the Yanks as well.

There are strict MEU criteria. Arms sales are for self Defence only and there is no provision for the approval of arms supplies to Militant Groups or any Government that can use those weapons against civilians. This is the reason why arms deals to the RoC are prohibited because of the possibility that these arms could be used against the TCs as well as fears that the technology could be shared with other third parties such as Russia.

So whaaa whaaa ... Go and have another hissy fit bitch! :lol:

Further to this, the riot gear example is valid.

Let's say Turkey ordered some riot gear during the Istanbul Riots or even Greece for that matter during the austerity riots.

The sale of this equipment would be prohibited because of the possibility that it could be used to violate the HR of peaceful protest.

So the chances of selling or supplying rebels is zero and there is no provision for it as weapons can only be sold to legitimate Governments and for self Defence only.

No gifts. The legislation also covers military aid. There can be no aid given to anyone other than a sovereign country.

And even then, some countries are on the ban list such as the RoC/CNG. Cyprus can order Australian Arms but Australia won't sell. Same rules apply for the US!
