Property/Land Purchases in RoC & Occupied Cyprus

My wife and i are moving to her families village in Paphos area (generations have lived there) in the coming years.

I have seen a MSN message board of lots of UK people buying in "TRNC" and being concerned as to "their" houses/land being returned to previous owners in case of a settlement to the Cyprus problem.

Obviously it seems that land is sold that isn't there to be sold but i have also read that in RoC the land that was "vacated" by TC families is "protected" and cannot be developed/sold - is this BS ?

Looking for more "legal" information basically.

PS. Of course i`m not looking to discuss the content of the message board - that can be done on another thread if so required.

Hi,

Yes, the TC properties in the South are protected by the Custodian of Turkish Cypriot Properties.

The Republic of Cyprus does not sell the TC land and after the solution TCs will be able to return to their properties.

On the other hand the pseudo state of "TRNC" doesn't even recognize that GC land exists in the north and whenever they feel like they give it to Turkish Cypriots, turkish settlers or foreigners. Of course the deeds that these people are given worth nothing since they are issued by an illegal and unrecognized state. So basically they pay to illegally rent the property for an unspecified time period which can be 30 years, but it can be 3 years also.

Therefore such an investment in the occupied Cyprus is not only illegal but it is also very risky. Those people should know that they have absolutely no right and absolutely no legal ownership over what they consider as "their" properties. Actually it is very possible that when a settlement is found, those foreigners not only will not be able to sue anybody to get their money back (since the "TRNC" will not exist), but the legal owners might be able to sue them for unauthorized use of their properties, like it happened in the case of Titina Loizidou.

True to what piratis said unless the lands in the north were actually owned by t/c pre'74 which can be legally sold all the rest are disputed as the owners are from southern cyprus and hence the TRNC should not be selling them unless they are compensating the true owners.

my advice is above only buy t/c land owned from pre'74 as all the rest will have inherent problems when the island unifies.

I think there is anow a problem with buying pre 74 T/Cypriot and Foreigner land as the Land registry in the Occupied Zones is no longer identifying pre-74 land as such.

The Government, which fell two weeks ago, was to introduce legislation, such that any new plots/homes bought by foreigners would only be on a 125 year lease aftre which it returned to the State.
