Two solicitors accused over file-sharing ‘bully tactics’

The Solicitors Regulation Authority has referred two solicitors from London firm Davenport Lyons to the Solicitors Disciplinary Tribunal over claims that the firm sent ‘bullying’ letters accusing hundreds of people of illegal file-sharing.

Consumer group Which? complained to the SRA in 2008 that Davenport Lyons partner David Gore and former partner Brian Miller had engaged in ‘bullying’ and ‘excessive’ conduct, while acting on behalf of client copyright holders.

It said the firm had sent out hundreds of letters, demanding compensation and costs for copyright infringements, and threatening court action.

Solicitor charged clients by weight of their file

A solicitor has admitted calculating how much he would charge the estates of dead clients by weighing their files in his hand.

Trevor Hobden, 47, was struck off after the Solicitors' Disciplinary Tribunal heard that he charged almost triple the proper fee and billed for thousands of pounds when he had done no work at all.

Asked by investigators how he calculated fees Hobden said: 'When you cost a file you put it in your hand and weigh it.'

Leicester solicitor charged with murder tried to 'fob off' his clients

Clients of a solicitor charged with murder say they were "fobbed off" with excuses as he tried to cover up stealing their cash to fund his lavish lifestyle.

Customers of city law firm Corts and Co gave evidence at Nottingham Crown Court yesterday in the trial of John Cort and Brian Farrell.

Solicitor Cort is accused of hiring Farrell to kill his business partner, Vina Patel, in the hope he could claim a £1.5m life assurance pay-out.

The prosecution alleges he needed the 51-year-old dead to cover spiralling debts, which included more than £650,000 they say he stole from nine clients the firm was representing in the sale or purchase of homes.

Martin Davy, 46, allegedly pilfered money from a trust fund set up to handle the compensation for a victim of sexual abuse by the Irish Catholic Church. He is also accused of stealing more than £16,000 from his firm.

He was yesterday charged by police with nine counts of theft and two counts of false accounting between May, 2004, and November, 2008. They also asked for a further theft charge to be taken into consideration.

Accused solicitor stands for office

The Law Society was embroiled in a new controversy last night when it emerged that a candidate for a seat on its ruling council is a solicitor who faces a £1.6m fraud trial and failed to mention the fact in his election statement.
Paul Baxendale-Walker, 38, and another accused, were charged in November 2000 with defrauding the pension fund of a now defunct manufacturing business. The serious fraud office, which is handling the prosecution, said the trial was expected to last three to four months and was due to start in September.
