Do you understand that now we are in Europe and such restrictions are impossible? Even if just one citizen files a suit at the European court of human rights every such restriction will have to be abolished.

No,it is not ! You are wrong. We call these derogations and EU accepts temporary derrogations! Also according to past court decisions, court take care of regulations for peace and order. So court is going to take care of peace agreement. It must be so sensetive because if it abolish this restrictions peace and order can damage badly!

The Annan plan did not satisfy our human rights demands and the court would never accept its provisions. This is why the Annan plan said we would not be allowed to take neither Turkey to court, nor the new republic ( considering we had accepted the Annan plan ).

Derrogations are accepted BEFORE a Country become a full member of the EU.After that bitti.
But anyway I am not absolutely sure.If you have examples of derrogations any Country got AFTER it joined the EU I will be glad to hear them.

We are not going to join to Republic Of Cyprus but a new order will be set up!

Also of course there can be derrogations but they can't be permanent!

Peace my question was

If you have examples of derrogations any Country got AFTER it joined the EU I will be glad to hear them.

So can you answer to the point yes or no?

IT IS the Republic of Cyprus that joined the EU, with its full geographical area, either you like it or not. Simply the Communautaire Aquis is suspended from application to the occupied areas. And it is for this reason that you are getting EU aid, as a part of the Republic of Cyprus, not as a separate state. If you don't like it, send the EU money back to them.

Derrogations from the Aquis are simply impossible to be incorporated into any sort of solution after May ist 2004. Because they will collapse within months after individual people question their validity at the EU court. And beleive me it is not the GCs only who will do that. It is the TCs as well. And like it or not the solution will be regarded internationally AND in the EU as a successor of the CYPRUS REPUBLIC, thats why 98% of its laws will continue to apply. Otherwise new accession talks would be needed for the new entity to be accepted in the EU.

Of course in your imagination you may think of whatever you like, e.g that Cyprus Republic is dead, it died in the 60s, the new Order will not be the Cyprus Republic and stuff like that. The reality is different.

To have a Federation with guaranteed majority in your area, derrogations from basic human rights are needed, and most important the massive expropriation of peoples properties without immediate compensation and at the same time their properties donation to illegal holders.Because the majority of the properties in the north ARE NOT YOURS. Who would ever accept such a thing other than those who would get the free properties?

My shouting for a Unitary State is not a slogan I invented recently to satisfy my sadistic dreams for domination on you community (as you may think). It came after a lot of thinking and scrutinising on how would it be possible to have a stable system while at the same time your community will be the boss there where you will be the majority. Only a Unitary State that in the beginning will be bi-regional by facts (not by law) will provide such a stable system. Whether it will always remain bi-regional I cannot say and I cannot guarantee. What is more important for me is the new state to be STABLE and be able to survive through the Centuries to come. And the TC community to have written clauses in the constitution for its Political rights, for its percentage of participation to the new state as well as for other specific concerns and worries it may have.

There isn't any. After a country joins to the EU, it's the EU laws and principles (along with derogations you managed to obtain) that are above everything.

Yes,permanent derogations can't be! But temprary ones can be !
Don't you remember 5th Annan Plan's content! EU supported it and found a formula for derogations ! Derogations will come into force with an act !
Also its possible that these derogations can be also permanent with the vote of all other EU members.

As you know dear MicAtCyp,after solution Republic Of Cyprus won't exist!

Not free,all will be compensated!

Also don't imagine solutions that won't satisfy Turkey.Turkey has self-interests here! The ones that you have to find a solution is NOT TCs but there is Turkey also!Ah,also don't forget England and Greece!

Unitary solution is only a dream! Why?Because we won't aceept such a thing! NEVER! Solution will be federal! Also don't forget after all things happened in the past %99 of TCs will reject Greek Cypriot dominance and unitary solution! It's time to see reality! You are not alone in Cyprus problem and all you wanted won't be!
