Very simple..
lets talk law now.

You must of entered Cyprus either with one of the two ways to be on the stop list.

A) you were smuggled through the Turkish side coming from Turkey . in this case you get a stop list as you entered / stayed in Cyprus illegally.

B) your visa run out and in the same time you were involved in an illegal activity because automatically if you are clean (not wanted by the law for any case) you dont get on the stop list you need someone to report you for a criminal offence and based on the report you get a stop list.

In Case A any immigration lawyer can be of a great use and help, he/she will photo copy original European marriage certificate, Polish residency (any legal documents prove you are staying legally within Poland) and your wife passport, go to the court and simply take off your name from the stop list based on the fact that you are LEGALLY allowed to move freely within Europe if you are a European spouse .. dead easy takes no time.

In case B) here lies the problem... If your name is on the stop list for anything that regards court/police/traffic police you will need a lawyer to pay your fines and you will probably have to face the law and serve a sentence..

hope that was helpful....

P>S fly over without a visa and they cant stop you in the airport even with a stop list ...... and yes this is the law son.

I don't think so, fly over with no Visa as a third country national and you'll get sent back. Simples.

Wife or no wife, EU or not, if you have not applied correctly, you do not get in.

Why take the chance?

For example, if an airline brings anyone to the States who is required to have had a visa beforehand, that airline is automatically fined $10,000 dollars and is also responsible for all the costs to send the passenger without a visa back to his home country and not just to the country where the passenger boarded the plane to come to the States. In all reality, I doubt any airline would allow a passenger to board their planes Cyprus bound or anywhere else for that matter when they are traveling on a passport needing a visa to the visiting country. Basically, the passenger will be spending money on a airline ticket he won't be able to use or even get refunds if it's a non refundable ticket, since ALL passengers are responsible to have ALL the required documents for travel to any particular country.

What this guy should do is, since he is married to a Polish lady, is to settle down in Poland long enough for him to get a Polish citizenship and then come to Cyprus, because since Cyprus is not part of the Schengen free movement agreement which allows EU citizens or anyone else who is already within the EU boarders, for them to travel without having to show any documents withing the EU members who have signed the Schengen treaty on free movement, which also includes Switzerland, even though the Swiss are not even an EU member. I'm sure that's how he is able to go to other EU member countries he is talking about. I bet he can't go to UK either without first obtaining a visa at a British embassy in Poland, for the same reason as Cyprus, since they too have not signed onto the Schengen free movement treaty!
