hi i have been told by my landlord he is selling the property and to look for another house.I found a house rang him today to give notice to leave end of september.Due to having to look for another place quickly i cannot afford the last months rent .I have told him my deposit will be used as last months rent and he hit the roof.this place has not been decorated for 3 years and he says i have to paint it before i leave and pay last months rent.He has threatend to get his lawyer onto me and evict me before end of september..Can he do this?, Can he come and change the locks on house if i goout?..I have 2 small kids as well..plz advice will be good

I am not a lawyer... but I believe the deposit could be used for fixing some damages if there are any so it is possible that you would have to pay the whole or part of the rent for the last month. So theoretically he could sue you if you pay nothing for the last month. What he can not do is to come and change the locks. If he does this then you can sue him because I am pretty sure it must be illegal.

Did you have a contract ?? if so did he break it ??? and if your contract is not stamped the landlord was probally not paying any tax on it ...worth a try to throw that back at him...

He cannot evict you unless you fall into 2 months in arrears. Then he needs to get a court order.

If he approaches or tries to change any locks call the police he has no right.

The painting and decoration is HIS responsibility not yours.

If you have caused no damages and all the bills are paid upto date then there is no real reason why you cannot use the last month rent as the deposit. Although the correct way is to pay up to date and have the deposit returned, but judging by what you said I doubt he would return it!

Your contract should state these things anyway, if you have one, but even if you don't, he can't just act with impunity.

Let him sue you, it'll cost him much much ore and it's just threatening tactics.

In short tell him to go jump.

The police number is 112.

Edit: Have just managed to get my self up off the floor for laughing so much. Sue you? He's having a laugh, you need 5 years+ before it gets to any court and will cost him thousands. Tell him to bring it on.

yes i had a contract which was not stamped at tax office

Thnx for the reply..im sure wot u say is correct and hes trying to scare me into paying him,but i cant give him what i havent got..there is no damage except it needs painting..thnx again
