On a more serious note deathstar, if you are both on the lease, the lease is an agreement, a contract. You have agreed to pay rent for however long the lease is. That contract is binding towards the landlord and towards your roommate.
Your roomate will not recieve the deposit back until the lease is up. So he can tell you you have to wait until then to get your money back, since you are the one breaching the contract. Considering that he will have to pay yours and his part of the rent for a while after you leave until he finds a new person to move in, he can then take your share of the rent out of the amount of the deposit and you might end up owing him money. Now of course he can be nice and just give it to you. But you cant legally make him do that. And if you go destroying property just because he made you mad you will find yourself in trouble. My advice is ask him and if he says no then walk away.

deathstar, wanting your money back and insisting on it will only get your roommates buttons. consider it gone, honestly, just be lucky you dont have to give any more. not unless your a big guy who can scare him to believe that he'll owe you the money, which im sure hes not that dumb. but this sounds a little like england not paying rent to cyprus. do you think cyprus will ever see any of the rent money from england. instead, england is siding with the turks to avoid future payments, get my drift. no one ever said life was fair
