That is a difficult one!

I’d suggest using a solicitor recommended by somebody other than your developer.

There are plenty around and plenty of people that have bought houses recently! It really isn’t difficult to find a good solicitor that also works well by e-mail (important if you are back in the UK while the contract is being sorted out).

My thought is personal, because I 'know' the developer.

The developer comes from and has family living in my village and is devoloping land in my village, under these circumstances I think he would be foolish to try to con a friend of mine who wished to buy one of his properties.

What do you think?

Hi,

I have read your replies with interest,quite varied but the message seems to be clear in, not to use the contractors Advocate , however us being in Scotland with 3weeks to go in paying the first 30% what questions needs to be asked if any to my solicitor in Cyprus or is there only a small needle in the haystack bent so should I trust him as any other independent solicitor who I would take on to do my conveyancing etc. bearing in mind that we don't know any reputable solicitors there.

As I mentioned in my earlier post, it is probably a little late to worry about it now.

As Svetlana said, one of the most important issues is that once you have paid for the property it is free from mortgage. Many developers mortgage the land to pay for the building. I know of a number of couples that have bought houses for CY£180,000 only to find that there is a mortgage for the same amount on the land. Clearly, if the developer defaults on the mortgage payments, the bank doesn’t care what you have paid him for it.

Ask him if there is a mortgage and if so, a letter of undertaking that it will be removed when your final payment is made.

I can recommend a couple of solicitors that work well via e-mail but it really is too late to start re-writing the contract unless you are willing to get the whole thing torn up and start again?

I'm in the process of looking for a solicitor and in one of your messages you say you can recommend a couple. I'm looking at buying in the Paralimni/Protaras are and would appreciate any details you can supply.
