thank you all for your advice! Went to see the developer today he has offered us another property a bit larger than what we have for another 35.000. He was very understanding and offered to put right what was wrong and explained why the plans have changed, pretty good reasons really. Now we are just going to see if we can borrow the extra money for the other property as we are still not happy about the distance between us and next door, and this cannot be changed. Im just worried now if we cant get the money that we will be stuck with what we have. We will see, thank you again everyone i knew i could count on you.

Hi Littlemiss,

I hope things work out for you.

With regard to neighbouring properties, if it's a detatched property then the minimum distance beween a property and it's boundary wall is 3 metres (so you should be a minimum of 6 metres away from your neighbour's house).

There are some exceptions if the building is non-inhabitable, for example a garage. This can be built on the boundary wall.

Oh and if you're next to a designated 'green area', the rules are different again.

ah thanks for that, that explains why he said he is building a storage cupboard between us for next doors use.

Yes, if he 'links' the buildings by an arch or whatever, the 3m rule no longer applies!

Thats all nice and dandy but the issue should be resolved in a way that you dont have to put up any more money. He changed the plans without asking you and the final product isnt what you are paying for. You are not stuck with it unless you decide to be. Contact a lawyer before it is too late.
