Im having a house built, and went to see how it was going the other day... not a happy bunny! Im suppose to be having a detached bungalo 2 bed 1 bath. I went to see and they have decided to build in a shower room as well as the bathroom, taking some of the space off our already quite small lounge. We did not ask nor were we consulted about this and it certainly isnt on the plans. Also on our plans there is a drive between us and the ppl next door, now we are so close to them we might as well be attached! The house is also facing the wrong way, and they have not built the arches we requested on the front of our house ( that is now round the back.
We certainly are not happy with it at all and this is not the house we were sold!
What do you think I can do about this? Can we get our money back, or can we ask to be moved to another house, even if we pay a little extra? Where do we stand?
Just like to get your opinions on this one cos between the lot of you i know you can say something useful.
We just feel a bit conned.

Well personally if it wasn't the house i bought i would just tell them to stop and either fix it or return the money. If you have enough proof of what you bought they have no choice. Do not let them continue or it might seem like you are approving the constructing and this might be used against you.

If you are using a large developer i am sure they will accomodate. Did you speak to them? what did they say?

going to go see them tomorrow, just wanted a bit of an idea of things to say and what my rights are before i went you know knowledge is power blah blah blah. Im dreading it though what if there is nothing i can do, bang goes my 40.000

nigel howarth may be able to help and he is on here, just put it in the thread at the top of the forum, on buying houses and see what he says.

If it is not the house that was depicted in the plans that you approved, you have lots of rights. If tomorrow they do not seem accomodating, I would contact a lawyer.

Would I be right in thinking that title deeds will not be granted as the design of the house is different to the plans submitted?

They are not building you what you have paid for.

First action: contact your lawyer, you has a strong case.

Hi Littlemiss,

Somebody alerted to me to your post - apologies for delay in replying.

On the face of what you say, the developer is in breach of contract and there appears to be a very good case for getting your money back.

But it's essential that you take independent legal advice. I suggest that you use on of the law firms listed on the website of the British High Commission in Nicosia as these are possibly more reliable than your run-of-the-mill lawyers.

When you visit the solicitor, make sure you take all the paperwork, contracts, drawings, advertising material and all communication with you.

Also, don't pay the developer any more money until the issue's been resolved.
