In short,i purchased a smartphone in Cyprus from a famous/popular shop last year(with standard two years warranty).
This year,i had a problem and i give it to repair...........and a little nightmare starts.
With a little shout and pressure the problem is close to be resolve,but i want to ask:
1)How much is the maximum time where one electronic device can be on repair(they say me that there is no such time,but i know that this is not correct).I know that in many European countries the maximum time is one month(up to 30-31 days ,it depends of the months) and if the electronic is not repair until one month you have right to receive your money or receive a replacement-i am not 100 % and for this reason i want to ask,how is in Cyprus ?
2)During the repair,the warranty stops to be count and the warranty must be extended with the time when the electronic is on repair.
For example if the electronic is on 20 days on repair,they must extend your warranty with 20 days also.
Is this correct for Cyprus ?

It goes something like this…

A. Number of days passed from the day you took it there to the day someone actually had a look at it. (Diagnoses commences)
B. Number of days passed from the moment the technician started looking at it and the moment he placed an order for a part (Diagnoses completed)
C. Number of days passed from the moment Dubai or other parts center serving the ME, actually responded to send the requested part. (Part pending)
D. Number of days passed that the technician had the part in his possession and decided to sit down and install it. (Part received)
E. Assuming the part received was in a good working condition (sometimes they’re not so you have to start all over again) the device tests OK and they decide to call you to collect it. (Repair completed)

So the time taken to repair a device is basically… A+B+C+D+E :lol:

Under the trader guarantee, can I demand a refund if the product I bought is defective?
Not right away. The trader must give you a choice between having the product repaired or having it replaced - unless either solution is disproportionate. Only if neither solution is practicable (e.g. if it would take too much time or be too costly to repair, or if the same product is not available within a reasonable time) can you demand a refund under EU law. However, in some countries you may have the right to request a refund directly.

What means "if it would take too much time"-one month,two months,three months...........................six months...............................one year...............
if the same product is not available within a reasonable time

Again,what means reasonable time.
For example to change one simple battery -is between several hours up to tree days.............but i am waiting around 28-30 days-for me this is not reasonable.
What means reasonable time ?
1)Why there is no any mention of the specific time that they consider for "reasonable time" and "if it would take too much time"
2)I don't see in this document what happen with the warranty when your device is on repair-it is extended(which is logical ) or not ?

Have you spoken to the general manager there to find out exactly what is causing the delay?

ie: Is it a case of a part currently not available and on order?

ie: Is this a suspected stolen device under investigation due to a serial number blacklisting?

Sometimes there’s more to a story than meets the eye…

No-the case is on of the simplest.
I had bought the smartphone last year(with two years warranty),the device works great,but i have start to have the problem with the battery until you cant use the device because the battery turn off(this model is notorious about battery problem) even for several minutes work and turn off completely random(it can be 80 %,it can be 70 %).
The big delay is...............because we are in Cyprus :))))))))
I meet with several customers there which had similar experience.
For this reason i want to know what is the law(because first they say there is no maximum repairing time(which is not correct),after this minimum 30 working days(now start to count which days is working or not).
Any way,with a little pressure to manufacturer(where the phone is on repair) the case is close to finished-they say that there is a big chance next week to receive my phone.
But i want to know the law and next time not to be in such position
Thank to erolz66,i already wrote e-mails to consumer rights organisation and hope soon i will know what are the rights and maximum repairing time.

Next time order in any of the European stores of Amazon (.co.uk, .de is also available in English, but it is not hard to order from .it, .es, .fr either). In one occasion I had an A/V Receiver that started to have some issues nearly 2 years after I bought it from Amazon.de . It was not easy to deal with the manufacturer so I shipped it back to Amazon and they refunded to my credit card the full amount I paid 2 years earlier, no questions asked (because this was a known issue with that particular receiver). They even refunded me the cost of shipping the receiver back to them. On another occasion a Logitech Keyboard/mouse combo I bought online went bad 4 years later, but it had a 5 year warranty from the manufacturer. So I contacted Logitech directly and the mailed me a brand new keyboard/mouse, which was an even more expensive model, as they one I bought was not produced anymore.

The local stores have nowhere near the customer service of Amazon. Their one advantage could be that they could serve you faster, but in reality this doesn't happen. You get better and faster service from Amazon or by dealing directly with the manufacturer (if it is a reputable one).
